Jacob & Elizabeth Kitts Blessing versus Joseph Irwin, 1785-1788
This day came the plaintif by his attorney and the defendant altho solemnly called not appearing. It is ordered that the conditional judgment obtained at last court against the said defendant be confirmed and that a writ of enquiry of the damages be executed at next court.
The Commonwealth of Virginia to the Sheriff of Montgomery County greeting: We command you that you attach to much of the Goods and Chattles of the within named Joseph Irwin as will be sufficient to satisfy and pay the within mentioned sum of Five Thousand Pounds and costs; and that you secure the same in your hands, or otherwise provide that it may be forthcoming and liable for Payment thereof, as our justices of our said court, at the courthouse, on the fourth Tuesday in March next, shall in that part consider; and have then there this writ. Jacob Plesley vs Joseph Irwin / Trespass. The sheriff having returned on the copies granted a copy left , and the defendant failing to appear, on the motion of the plaintiff by his absence an attachment is awarded against the estate of the defendant for 5000 pounds returnable here….
The Commonwealth of Virginia to the Sheriff of Montgomery County greeting: We command you that you attach to much of the goods and chattles of Joseph Irwine late in your bailiwick, you cause to be made one Penny. Which Jacob Plesley late in our said county court of Montgomery recovered against him also 344 pounds tobacco and 15/. Which to the said Jacob in the same court was adjudged for his cost by him about his suit in this behalf refunded(?). whereof he is convict, as appears to us, of record. And that you have the same before the justices of our said court, at the court house, on the 4th Tuesday in May next to render to the said Jacob of the debt & costs aforesaid. The Commonwealth to the Sheriff of Montgomery County greeting: We command you to summon Esther Kinser, Elizabeth Moore, Michael Criger & Laurance Kattron to appear before our justices of our said county, at the courthouse, on the first Tuesday in June to testify, and the truth to say in behalf of Joseph Ervin in a certain matter of controversy in our said court, before our said justices, depending and undetermined, between Elizabeth Plesly Plaintiff and said Erwin Defendant and this you shall in no wise omit, under the penalty of 100 pounds each. Witness Abram Trigg clerk of our said court, at the said courthouse, the Day of XI year of our Independence. (1787)
Know all men by these presents that we Joseph Irwin and John Gullion are held and firmly bound unto Jacob Blessly. The ***** and full sum of nineteen pounds nineteen shillings current and lawful money of Virginia to the which payment well and truly to be made we bind our selves our heirs executors and administrators firmly by these presents. Sealed and dated this 2th day of September 1787.
The condition of the above obligation is such that whereas an execution issued from the county court of Montgomery at the suit of Jacob Blessly against the estate of Joseph Irwin which execution was levied on sundry goods the property of said Irwin. Now if the said Irwin do well and truly pay of and discharge said execution which amounts to nine pounds nineteen shillings within three months of the date of this presents with lawfull interest therein at the rate of 5******** then the obligation to be void else to remain in full force and virtue.

Whereof he is convict, as appears to us, of record. And that you have the same before the justices of our said court, at the cout-house, on the first Tuesday of September (1787) next to render the said Jacob & Elizabeth of the debt & costs aforesaid. The Commonwealth of Virginia to Mishaul Brown and Matthew Troy. Gentlemen Greeting. Whereas there is now depending and undetermined before the justices of our county court of Montgomery a certain matter in difference in a suit depending between Jacob Plesley complainant and Joseph Irvin Respondent the said Defendant having insinuated to us that he hath many material witnesses to be examined in his behalf to wit Sophia Hagner and prayed that a commission might issue for her examination. Now know ye that we trusting to your ability and prudent circumspection that the truth in the said matter contained may be better known we have assigned and empowered you or any two or more of you the said to cause the said witness to come before you at the court house of the said county or at what other place you may think proper sometime between this and the court to be held for this county on the fourth Tuesday in November next giving the adverse party notice of the time and place of your meeting and then and there the said witness to examine and interrogate in all things any wise material or relative to the premises and that you cause the deposition by you taken, also a certificate your proceedings togeather with this commission signed by each of you to be sent to our said court.
